These are some generalizations about the way that Workers Compensation Insurance typically works for the self-employed:
  • It's fair to say that self-employed people generally do not have to purchase coverage for themselves in order to comply with the law.
  • It's also fair to say that companies usually do not need to extend these benefits to independent contractors who work for them.
  • With that said, independent contractors and others who work for themselves usually have an option of purchasing this type of business insurance to protect themselves against a work-related illness or injury.
Even if an independent contractor might not need to be covered, it could be the employer's responsibility to make sure that subcontracting firms have properly covered their own employees. If a subcontractor isn't in compliance, the company employing them could be forced to extend their own coverage to these employees.

In some states, rules for this kind of coverage are pretty complex. Fines for violating them can be large; plus, the company might still be liable for injuries or illnesses.
